Oseyra for iPhone and iPad: terms of use

These terms are an agreement between you and Hatch Media LLC ("we") for the Oseyra app for iPhone and iPad. By using the app you agree to them and to Apple's Licensed Application End User License Agreement, which also applies. Questions: support@oseyra.com.

Who can use Oseyra

You must be 18 or older.

What Oseyra is

Oseyra is an AI companion. Your companion is software: it isn't a person, it can be wrong, and it says so. It isn't a therapist, doctor, lawyer or financial adviser, and isn't a substitute for professional help or emergency services. If you're in crisis in the US, call or text 988.

Subscriptions

• Plans. Oseyra Lite includes 2 hours of conversation a month (monthly or yearly). Oseyra includes 7 hours a month on the monthly plan and 6 on the yearly plan. Oseyra Plus includes 16 hours a month on the monthly plan and 12 on the yearly plan. Prices are shown in the app. All plans include every feature; they differ only in their monthly hours.
• Free trial. New subscribers get a 3-day free trial where offered. Payment is charged to your Apple Account when the trial ends unless you cancel at least 24 hours before it ends. The trial includes a limited amount of cloud conversation (currently 30 minutes), not the plan's full monthly hours, and extra hours can't be used during the trial.
• Billing. Subscriptions are billed by Apple to your Apple Account. They renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
• Managing and cancelling. Manage or cancel your subscription in your Apple Account settings (Settings → your name → Subscriptions), or from Settings → Manage subscription in the app. Cancelling stops the next renewal; you keep access until the end of the period you paid for.
• Refunds are handled by Apple under Apple's policies: reportaproblem.apple.com.
• Hours of conversation. Your companion thinks and speaks on our cloud servers, so the app needs an internet connection to talk. Your plan's hours are time on those servers, measured from the first message of a conversation to the last, including pauses of up to 5 minutes, plus a few minutes for each conversation while the server starts and stops. When a month's hours are used up, cloud conversations pause until your next monthly period unless you have extra hours, and your companion may keep talking with you using your device's on-device AI where it's available.
• Extra hours. With an active plan you can buy packs of extra hours (2, 5 or 10 hours) in Settings → Subscription → More time. Each pack is a one-time purchase billed by Apple to your Apple Account, not a subscription. Extra hours are used only after your plan's monthly hours run out, don't expire while your account exists, and can't be transferred or exchanged for cash. They're tied to your plan; if you delete your account, any unused extra hours are deleted with it. A pack Apple refunds is removed from your remaining extra hours.
• We may change plans and prices; Apple will tell you about any price increase before it applies, as Apple's rules require.

Your license

We grant you a personal, non-transferable license to use the app on Apple devices you own or control, under Apple's rules. You may not copy, reverse engineer or redistribute it except where the law allows it.

Acceptable use

Don't use Oseyra to break the law, to harm or harass others, to create content involving minors in any sexual way, or to imitate a real person without their permission. Don't try to get around the safety features or subscription checks, or attack our servers.

Your content

What you say, the things you let your companion use, and what your companion says back are yours, and are stored on your device. You give us permission to process the parts of them needed for each reply on our servers, only to produce that reply and its speech, as described in our privacy policy; we don't keep them or use them to train AI.

Actions your companion takes

When you ask, your companion can add calendar events and reminders. It acts only on your request, and you're responsible for what you ask it to do.

No warranty

Oseyra is provided "as is". We work hard to make it reliable and kind, but we don't promise it will be error-free, always available, or right about anything. AI replies can be inaccurate.

Limit of liability

To the fullest extent the law allows, Hatch Media LLC isn't liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim.

Apple

These terms are between you and Hatch Media LLC, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide maintenance or support for it, and isn't responsible for any claims relating to it, including product liability, legal or regulatory claims, or claims that it infringes someone's intellectual property. If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you're not in a country under a U.S. Government embargo or on a U.S. Government list of prohibited or restricted parties.

Ending these terms

You can stop using Oseyra at any time. We may suspend access that's used in breach of these terms.

Governing law

These terms are governed by the laws of the State of Florida, USA. Disputes will be handled in the state or federal courts located in Palm Beach County, Florida, unless the law where you live gives you the right to bring them elsewhere.

Changes

We may update these terms. We'll update the date above and, for significant changes, tell you in the app before they apply.
